STV group plc - STV Player - Terms and Conditions of use. You must carefully read and then agree to the terms and conditions set out below before accessing and using the STV Player or any contnet. If you do not wish to be bound by these Terms and Conditions, you may not access or use the STV Player or any content.
The STV Player is owned and made available by STV Group plc of Pacific Quay, Glasgow, G51 3PR (referred to in these Terms and Conditions as "we" and "us" and our group companies including but not limited, stv Central Limited, stv North Limited, SMG Productions Limited & Ginger Television Productions Limited) ("Group Companies").
These Terms and Conditions form part of an agreement between you, the end-user, and us, and that agreement sets out the conditions under which you may access and view streaming television, clips, advertisements, text, photographs, forums, user submitted material, comments or contributions and any other audio and video content (the "Content") available through the STV Player on our website at http://video.stv.tv (the "Website").
Use of the STV Player and any related parts of our Website constitutes your acceptance of these Terms and Conditions.
There may be other terms and conditions within areas of the Website, which relate to your use of such areas, and such other terms and conditions will, together with these Terms and Conditions, govern your use of the Website.
We reserve the right to change these Terms and Conditions and any other terms and conditions contained elsewhere on the Website at any time. It shall be your responsibility to check regularly to ensure that you agree to any such amendments. If you do not agree to any changes that we have made, you should stop accessing the Website and the STV Player immediately.
You must be at least 18 years of age to view a programme on the STV Player which has a parental guidance indicator "G" setting.
Parental guidance controls have been set on the STV player to material which STV has pre-identified as unsuitable for children and young people. A statement of age is required in order to access such material.
If any child or young person has access to your computer then you are responsible for setting an appropriate level of protection. If you do not set up parental controls on your computer then any child or young person using your computer may be able to access all content available on the STV Player, including any content which has been labelled "G" for Guidance required (see below)*. Please use the parental controls on the STV Player to set the appropriate level of control.
If you chose to disable the guidance controls on your computer, then any child or young person using your computer will have access to all content available on the STV Player, including any content which has been labelled "G" for Guidance. If you choose to set a password, then any child or young person using your computer will only be able to access such content if you have provided them with your password.
You are responsible for keeping your password secret at all times. If you permit a person below 18 years of age to use the STV Player, you are solely responsible for determining whether the content is suitable for that young person to view.
Some of our Content may have been shown after the 9pm watershed and/or may contain material you may consider indecent, objectionable or offensive including but not limited to strong language, violence, nudity or scenes of a sexual nature. We will endeavour to label such Content using the "G" symbol for Guidance and to give you guidance so as to enable you to make an informed choice before viewing such Content and permitting any person below the age of 18 to access such Content on your computer.
We take "geo-blocking" measures to prevent access to some of our Content by you if you are located outside the United Kingdom. This is because we are subject to certain broadcast or licence restrictions in respect of such Content. You agree not to circumvent such geo-blocking measures or to access, or attempt to access, such Content if you are outside the United Kingdom.
The Content is protected by copyright and/or other proprietary rights (the "Intellectual Property Rights").
The Intellectual Property Rights in the Content remain with us, or where any Content has been licensed to us, with the rights owners of such Content. Any names, graphics, images, trade marks, trade names and logos identifying us or our Group Companies, our partners, customers or any third parties and any products or services belonging to us or them are proprietary and may not be reproduced or otherwise used without express permission.
We may take technical measures to protect the security of the STV Player and any Content. You may not take any steps to interfere with, cause damage to or circumvent any such technical measures, or unlawfully access our servers, systems or attempt to access any users' data, nor shall you attempt to do so.
You undertake and warrant to us:
By submitting any material, comment or other contribution you hereby grant us a royalty-free, irrevocable, perpetual, worldwide licence for us to use or authorise others to use your material, comment or contribution in all media whether now known or hereinafter developed.
You also hereby waive any moral rights you may have in such material, comment or contribution.
You warrant that your material, comment or contribution is original to you and will at all times comply with our Acceptable Use Policy.
Any "catch up" or archive Content available on the STV Player is not live. Therefore please do not respond to any invitation to enter any competition, phone in, vote, quiz or any other interaction as the interaction may have come to an end. If you do so, you may still be charged and your interaction is likely to come too late and therefore not be included or considered.
We shall have the right to immediately suspend or terminate your access and use of the STV Player if you commit a breach of these Terms and Conditions, and we shall have the right to remove any comments or material posted or uploaded by you that we, at our sole discretion, consider to be defamatory, or otherwise in breach of any of the above warranties.
You will compensate us in respect of any and all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these Terms and Conditions by you.
The STV Player and any Content is provided on an "as is" and "as available" basis without any representation, endorsement or warranty of any kind, express or implied (by law or otherwise) to the maximum extent permitted by law. Specifically, we do not warrant: (1) that any functions on the STV Player or any Content will be uninterrupted or error free; (2) that any defects which may occur will be corrected; (3) that the STV Player, the Content or the server that makes the STV Player and the Content available, are free from bugs, defects or viruses; or (4) the accuracy of the Content.
In no event shall we be liable for any loss or damage, howsoever arising, out of or in connection with your use of the STV Player or your access to any Content, including, without limitation, direct or indirect loss, consequential loss or damage, loss of profit or goodwill, loss arising from use or inability to use, loss arising from any errors or omissions in the STV Player or any Content, loss arising from any incompatibility with your system, loss or damage due to any bug, defect, computer virus, worm, trojan horse or other malicious code, or any other loss or damage as a result of breach of contract, negligence, delict or tort (except in respect of death or personal injury arising from our negligence or any other liability which may not be excluded by any applicable law).
Please note you are solely responsible for any charges from your internet provider in connection with your access to any Content on the STV Player.
If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of law then, to the extent and within the jurisdiction in which that Term or Condition is found to be illegal, invalid or unenforceable, it shall be severed and deleted and the remainder of the Terms and Conditions shall survive, remain in full force and effect, and shall continue to be binding and enforceable.
